Scope and Contents

Elreta Alexander served as executor for Dr. C.C. Stewart (mentor to her husband, Dr. Girardeau Alexander) and Dr. C.C. Stewart's daughter Agnes Judith Alexander (nee Stewart). The documents in the Stewart Family, 1943-1965 and Stewart Family correspondence, 1954-1965 (bulk 1964-65) folders relate to the execution of the wills and distribution of land in Jamaica. William Raulston was charged with sale and possession of marijuana in 1976, but the case became controversial when the felony charges were transferred from Superior Court to District Court. Judge Seay ordered a hearing to see if the charges were properly handled and subpoenaed Judge Elreta Alexander and then district attorney Joseph Williams. Raulston's attorney claimed that the cases were transferred to District Court because a plea bargain had been entered into with Williams. Arch Schoch (Raulston's attorney) also testified that "bills of information" superseded indictments against Raulston. Judge Seay ruled that no valid plea bargain had been entered and the "purported" bills of information did not constitute "proper legal process." Although a grand jury had indicted Raulston, the cases were brought before Judge Alexander. She initially entered a judgement sentencing Raulston to a first offender's program. She later said she had no jurisdiction in the case and sent them to Superior Court. At one point the Judidicial Standards Commission investigated a complaint against Judge Alexander concerning her actions in the case, but was cleared of any wrong-doing in the case. The case is further complicated by the fact that many mis-steps occurred along the way. Law enforcement circumvented the District Court and presented the facts for the case directly to a grand jury, Schoch asked a county clerk to docket the case with the District Court, while at the same time arranging a plea bargain with district attorney Joseph Williams, and finally, Judge Alexander took issue with the press' handling of the case. Folder originally marked "Raulston Judicial Standards" mostly comprised of correspondence related to the Judicial Standards Commission investigation of Judge Alexander. A few news clippings with notes are included. Arranged chronologically. Transcripts from court proceedings dated 8/15/77 and undated (1977) are marked, "State of North Carolina vs William M. Raulston." 9/26/77 transcript lacks title page. Arranged chronologically. News clipping folder concerns the Raulston case and following proceedings, collected by Judge Alexander arranged in chronological order. Also includes a few typed and hand written notes.
